Welcome to ArchiWorld.in (the “Website” / “Platform”). These Terms and Conditions (“Terms”) govern your access to and use of our platform, operated by ArchiWorld Private Limited (“Company,” “we,” “us,” or “our”), a company incorporated under the laws of India.
By registering, accessing, or using the Platform as a Job Seeker (Architect/Designer) or a Recruiter (Employer/Firm), you agree to be bound by these Terms. If you do not agree, please do not use our services.
1. Eligibility & Registration
Minimum Age: You must be at least 18 years of age to register.
Architect Credentials: If registering as an Architect, you represent that you hold a valid degree or are currently enrolled in a recognized architecture program. Where applicable, you are encouraged to provide your Council of Architecture (CoA) registration number.
Account Accuracy: You agree to provide accurate, current, and complete information during registration and keep your profile updated. You are solely responsible for safeguarding your account password.
2. Intellectual Property (IP) & Portfolio Uploads
As a highly visual platform hosting design files, we take Intellectual Property seriously.
Retained Rights: Job Seekers retain 100% ownership and copyright of all portfolios, 3D renders, CAD drawings, mood boards, and text uploaded to our servers.
Limited License to Portal: By uploading files, you grant us a limited, non-exclusive, royalty-free, worldwide license to host, store, cache, display, and distribute your work strictly for the purpose of showcasing it to prospective employers on the Platform.
Third-Party Permissions: You warrant that you own or have the necessary licenses and permissions to upload the designs in your portfolio. You agree not to upload drawings or confidential assets belonging to past employers or clients without their explicit consent.
3. Recruiter Download Policy & Restrictions
To protect designers, recruiters are bound by strict rules when downloading files from our platform.
Recruiters may download Job Seeker portfolios solely for the internal evaluation of the candidate for an active or potential job opening.
Downloading portfolios to build a private database, train AI models, or benchmark designs without intent to hire is strictly prohibited.
No Plagiarism / Unauthorized Sharing: Recruiters must not copy, reproduce, distribute, publish, modify, or commercially exploit any downloaded designs or portfolios.
No Impersonation of Work: Presenting a downloaded portfolio or any design therein as the recruiter’s own work is a material breach of these terms and constitutes copyright infringement under the Indian Copyright Act, 1957.
Immediate Termination: Any recruiter found violating these terms will face immediate, permanent account termination, and their details may be shared with law enforcement or the affected designer for legal action.
4. Limitation of Liability (The Portal’s Shield)
Please read this section carefully as it limits our liability regarding downloaded portfolios.
No Post-Download Control: Once a portfolio file is downloaded by a recruiter, it leaves our technical environment. ArchiWorld has zero technical control over how the recruiter stores, uses, or shares that file.
No Liability for IP Theft: We act solely as an intermediary. We are not liable for any copyright infringement, design plagiarism, patent/trademark violations, or misuse of design assets committed by recruiters or any third party.
User Discretion: Job seekers acknowledge the risks of the digital medium. We strongly advise against uploading:
Working/construction drawings with exact dimensions.
Proprietary, un-watermarked high-resolution renders.
Highly sensitive, unpatented structural designs.
5. Prohibited Activities
All users agree not to:
Upload files containing viruses, Trojan horses, or malicious code.
Use automated scripts, bots, or scrapers to harvest candidate portfolios or contact information.
Post fake, misleading, or deceptive job listings or candidate profiles.
In any way tarnish the reputation of other designers or firms on public forums within the portal.
6. Payments, Subscriptions, and Refunds
Free Promotional Phase: Access to the Platform — including creating accounts, posting jobs, searching candidate profiles, and downloading architecture/interior design portfolios — is provided entirely free of cost at launch for a promotional period.
Right to Introduce Fees: We reserve the right, at our sole discretion, to modify our pricing structure and introduce fees, premium feature tiers (e.g., featured job slots, portfolio boosts), or subscription models at any point in the future.
Advance Notification: Should we introduce a paid model, we will give all registered users a minimum of 30 days’ advance notice via email or a prominent notification banner on the Website before any charges take effect.
No Retroactive Charges: You will never be automatically charged for using the platform during the free phase. If fees are introduced, you will have the absolute choice to opt in to a paid plan or continue using any remaining free basic services.
7. Indemnification
You agree to indemnify, defend, and hold harmless ArchiWorld, its directors, employees, and affiliates from any claims, damages, liabilities, or expenses (including legal fees) arising out of your violation of these Terms, your misuse of the Platform, or your infringement of any third-party intellectual property rights.
8. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in New Delhi, India.
